Welcome to SpreadMasters, LLC. ("SpreadMasters", "we", "us", "our"). These Terms of Service ("Terms") establish the legal framework governing your access to and use of our website at https://www.spreadmasters.com (the "Website"), the SpreadMasters mobile application (the "App"), and all associated data, tools, features, content, and subscriptions offered therein (collectively, the "Service"). Your use of the Service is also subject to our Privacy Policy. Together, these Terms and the Privacy Policy constitute a binding legal contract between you and SpreadMasters (the "Agreements"). By accessing or using the Service, you confirm that you have read, comprehended, and consent to be legally bound by these Agreements. Usage of this Service is strictly forbidden for individuals or entities engaging in (i) any commercial or revenue-generating activities, (ii) professional sports trading, or (iii) employment with a sportsbook or daily fantasy sports operator. If you do not accept these Agreements in their entirety, you are prohibited from using the Service.
When you create an account, you consent to receive electronic communications from us, which may include newsletters, marketing promotions, and other account-related information. You can unsubscribe from these communications at any time by clicking the "unsubscribe" link provided in the emails or by contacting us directly at support@spreadmasters.com.
To complete a purchase of any product or service we offer ("Purchase"), you will be required to provide relevant payment information, such as credit card details and a billing address. You formally declare and warrant that (i) you possess the legal authority to use any payment method you provide and (ii) all information you submit is accurate, current, and complete. We may utilize third-party payment processors to facilitate transactions. We reserve the right to reject or cancel any order at our discretion, for reasons including but not limited to incorrect pricing, product unavailability, or suspicion of fraudulent or unauthorized activity.
From time to time, SpreadMasters may offer contests, sweepstakes, or other promotional events ("Promotions"). Participation in these Promotions may be subject to a separate set of rules, which will be made available to you. Should the rules of a Promotion conflict with these Terms, the Promotion-specific rules will take precedence.
Access to certain features of the Service requires an active subscription ("Subscription"), which is billed in advance on a recurring schedule (a "Billing Cycle"), typically monthly or annually. At the conclusion of each Billing Cycle, your Subscription will automatically renew under the same terms unless it is canceled by either you or SpreadMasters. You may cancel your Subscription renewal via your account management portal or by contacting our support team. A valid payment method must be kept on file. By submitting your payment details, you grant us permission to charge the applicable Subscription fees.
At our sole discretion, we may offer a Subscription with a complimentary trial period ("Free Trial"). To activate a Free Trial, you may need to provide your billing information. You will not be billed until the Free Trial concludes. On the final day of the trial, if you have not canceled, you will be automatically enrolled in and charged for the paid Subscription you selected. SpreadMasters retains the right to alter the conditions of or terminate any Free Trial offer without prior notice. A user is not permitted to register for more than one Free Trial.
SpreadMasters reserves the right to change Subscription fees at any time. Any changes to fees will take effect at the beginning of your next Billing Cycle. We will provide you with reasonable advance notice of any such change, allowing you to cancel your Subscription before the new fee is applied. Continuing to use the Service after a fee adjustment becomes effective constitutes your acceptance of the new fee.
Unless otherwise required by applicable law, all fees paid for Subscriptions are non-refundable.
Our Service allows you to post or share your own information and materials ("User Content"). You are solely responsible for your User Content and for ensuring it is lawful, reliable, and appropriate. You affirm that you own your User Content or have the necessary rights to grant us the license described in these Terms. While you retain ownership of your User Content, you grant SpreadMasters a license to use, modify, display, reproduce, and distribute it in connection with operating and promoting the Service. All other content, data, and materials found on the Service are the exclusive property of SpreadMasters, Inc. or its licensors. You are prohibited from distributing, modifying, transmitting, or using this proprietary content, in whole or in part, for commercial purposes without our express written consent.
You may not use our Service: (a) In any way that violates any applicable national or international law or regulation. (b) For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise. (c) To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation. (d) To impersonate or attempt to impersonate us, our employees, another user, or any other person or entity. (e) In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity. (f) To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of Service, or which, as determined by us, may harm or offend us or users of Service or expose them to liability. Additionally, you agree not to: (a) Use Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party's use of Service, including their ability to engage in real time activities through Service. (b) Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service. (c) Use any manual process to monitor or copy any of the material on the Service or for any other unauthorized purpose without our prior written consent. (d) Use any device, software, or routine that interferes with the proper working of the Service. (e) Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful. (f) Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service. (g) Attack Service via a denial-of-service attack or a distributed denial-of-service attack. (h) Take any action that may harm us or damage the Service. (i) Otherwise attempt to interfere with the proper working of the Service. (j) Use the Service or any part thereof as a sportsbooks trader or if you are an employee of any sportsbook or any daily fantasy pick'em product. (k) Use the Service as part of any effort to compete with us or otherwise use the Service and/or the Content for any revenue-generating endeavor or commercial enterprise.
This Service is designed for individuals who are at least eighteen (18) years of age. By creating an account and using the Service, you represent and warrant that you meet this age requirement.
When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
SpreadMasters provides data and tools for informational purposes only and does not offer personalized financial or betting advice. Any information on the Service should not be interpreted as a recommendation that a specific wager is suitable for you. You are exclusively responsible for evaluating the merits and risks associated with any betting decision you make.
You acknowledge and agree that you are solely responsible for your own betting strategies, decisions, and financial outcomes. SpreadMasters, its directors, officers, and employees shall not be held liable for any financial losses or other consequences resulting from actions you take based on information obtained through our Service.
The Service, including its underlying code, design, features, functionality, and original content (excluding User Content), is and will remain the exclusive property of SpreadMasters, LLC. and its licensors, and is protected by copyright, trademark, and other intellectual property laws.
THESE SERVICES ARE PROVIDED BY US ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICES, SERVICE DATA, OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, SERVICE DATA, INFORMATION, CONTENT, AND ANY MATERIALS OBTAINED FROM US IS AT YOUR SOLE RISK. NEITHER WE NOR ANY PERSON ASSOCIATED WITH US MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES. EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON OUR PART, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE SERVICE DATA AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights ("Infringement") of any person or entity. If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim as outlined below. You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail): (a) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest; (b) a description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work; (c) identification of the URL or other specific location on the Service where the material that you claim is infringing is located; (d) your address, telephone number, and email address; (e) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (f) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. We reserve the right to terminate or suspend your account and deny access to the Service immediately and without notice, for any reason whatsoever, including if you breach these Terms.
These Terms and any dispute arising from them will be governed by the laws of the State of Delaware, without regard to its conflict of law principles.
We may update these Terms from time to time by posting a new version on our Website. It is your obligation to review these Terms periodically for changes. By continuing to use the Service after amendments are posted, you accept and agree to the revised Terms.
No waiver by us of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.
BY CREATING AN ACCOUNT OR USING ANY PART OF THE SERVICE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS OF SERVICE.
